  6.      To amend the Federal Communications Act of 1934 to
  7. prevent the loss of existing spectrum to the Amateur Radio
  8. service.

  12.      Mr Cooper introduced the following bill; which was
  13. referred to the Committee on Energy and Commerce

  15.                            A BILL
  16.      To amend the Federal Communications Act of 1934 to
  17. prevent the loss of existing spectrum to the Amateur Radio
  18. service.
  19.      Be it enacted by the Senate and House of
  20. Representatives of the United States of America in Congress
  21. assembled,
  22. SECTION 1. SHORT TITLE.
  23.      This Act may be cited as the "Amateur Radio Spectrum
  24. Protection Act of 1991."
  25.  
  26. SEC. 2. FINDINGS.
  27.      Congress finds that--
  28.      (1) more than 490,502 radio amateurs in the United
  29. States are licensed by the Federal Communications Commission
  30. after a thorough examination in radio regulations and
  31. technical principles of radio communications, as required by
  32. international regulations;
  33.      (2) by international treaty and Federal Communications
  34. Commission regulation, the amateur is authorized to operate
  35. stations in a radio service of intercommunications and
  36. technical investigations solely with a personal aim and
  37. without pecuniary interest;
  38.      (3) among the basic purposes for the Amateur Radio
  39. service is to provide voluntary noncommercial radio service,
  40. particularly emergency communications;
  41.      (4) emergency communication services by volunteer radio
  42. amateurs have consistently and reliably been provided
  43. before, during and after floods, tornadoes, forest fires,
  44. earthquakes, blizzards, train wrecks, chemical spills, and
  45. other disasters; and
  46.      (5) the Federal Communications Commission has taken
  47. actions which resulted in the loss of over 100 MHz of
  48. spectrum to amateurs.

  50. SEC.3. FEDERAL POLICY REGARDING REALLOCATION OF AMATEUR
  51. RADIO SPECTRUM.
  52.      Section 303(c) of the Communications Act of 1934 is
  53. amended--
  54.      (1) by redesignating subsection (c) as subsection
  55. (c)(1); and
  56.      (2) by adding at the end of such subsection (c)(1) the
  57. following new paragraph:
  58.      "(2) The Federal Communications Commission shall not
  59. diminish existing allocations of spectrum to the Amateur
  60. Radio service after January 1, 1991.  The Federal
  61. Communications Commission shall provide equivalent
  62. replacement spectrum to the Amateur Radio service for any
  63. frequency reallocation after January 1, 1991."
